[Dream Love Green City Project] HAPPYBIKE Operation Guideline

◼ General Terms
1. This guideline aims to regulate conditions and duties for the usage of Dream Love Green City Project’s HAPPYBIKE Unmanned Rental System and other necessary terms.
2. If it is changed or partially revised in a homepage, an operator should notify people of it in a notice of the homepage of a control center (referred as Center) without delay.
3. If details that are not specified in this guideline are actually regulated in the relevant laws, regulations should be followed. Otherwise, general terms should be followed.
4. Definitions of terms used in this guideline are as follows.
  - Operator: A operation and control center of HAPPYBIKE
  - HAPPYBIKE: a bike that is available for unmanned rental and return due to the use of a smart phone application [Yeongcheon (별타고), Gyeongsan, Cheongdo, operated by three local governments]
  - Station: a place where users can rent or return a HAPPYBIKE.
  - Bike Port: a parking lot placed in a station where users can leave a bike.

◼ Target
1. Those who satisfy the following requirements among subjects who are eligible for insurance registered in operating agencies.
  - Those who are over fifteen years of age (those who are under 19 need to receive an agreement from their parents)
  - Those who can verify themselves through a mobile-service company (Foreigners are included)

◼ Charges for using
1. Free until December 31st, 2018

◼ Areas for Using
1. Roads in Yeongcheon-si, Gyeongsan-si, Cheongdo-gun
(Where it is possible to usually ride a bike except for mountainous MTB roads and unpaved roads.)

◼ Operation Time
1. Rental Time: One hour, A bike is available for rental three times a day (You must return a bike within a hour.)
2. If you exceed the set rental time for more than two hours, it is considered as being robbed.
  - 07:30~19:00 (April ~ September / except for holidays)
  - 08:30~18:00 (January ~ March / October ~ December / except for holidays)
3. Limitation / Change of Operation Time
In case of the occurrence of reasons in each issue, the operation time can be limited or changed.
  - Regular inspection or inspection at any time
  - weather deterioration
  - If it is admitted that another operator is necessary
※ Adjust rental hours depending on a change in the environment such as rain for the safety of users.

◼ How to rent
1. Join in once for the first time in a homepage or smart phone application and verify yourself.
2. Operate the smart phone application and log in.
3. Scan QR code attached in a bike port or bike in the app.
4. Start to operate a bike when it is unlocked.

◼ How to return
1. Put a lock key of the bike into an empty bike port where you can return it.
2. Temporarily return a bike in a pillar of a bike port in case of the absence of an empty port in a rental shop (There is a guide of how to temporarily return a bike with photos in a smart phone application)
3. A sign is sent to a control center via the smart phone app during the temporary return.
4. If you lock a bike by means other than a set bike port equipped in the bike, a user is obligated to pay for it because it is considered as leaving it alone due to your carelessnes.
5. If you lock a bike by means other than a set locking device, it is considered as being robbed
6. Confirm details that are contradicted or repeated with insurance.

◼ Usage Restriction
1. Those who exceed the rental time limit more than twice without specific reason such as accident – The relevant users are restricted to use a bike for a month.
2. Those who damage a system with carelessness, illegal acts, or improper acts – The relevant users are changed with a crime or restricted to use a bike.
3. Those who damage operators (manager, consultant, and others) through unreasonable demands other than regulations, abusive languages, sexual harassment, and others - The relevant users are changed with a crime or restricted to use a bike.
Under the law regarding the promotion of information and communication network use and protection of information, we apply a law of causing phobic anxiety.
Under act on sexual crime of violence, we apply ‘obscenity in communication media.’
  - We can restrict the use of a bike depending on other relevant laws and usage regulations.

If a bike is damaged by illegal acts, carelessness, and accidents, we will charge costs for a bike, locking device, promotion materials, and others attached in the bike to a person who is responsible for accidents and user who causes a mistake.

◼ Prohibited Matters and Duties and Responsibilities of Users
1. We forbid users from doing the following acts while using HAPPYBIKE.
  - Leave or return a bike at any place other than HAPPYBIKE’s stations.
  - Ride a bike with more than two people (except for tandem) or animals.
  - Remodel or transform HAPPYBIKE for personal use.
  - Ride HAPPYBIKE outside of available areas.
  - Infringe upon other users’ or third parties’ rights to ride HAPPYBIKE and other rights.
  - Drink or take any kinds of medicines before or while using HAPPYBIKE.
  - Use other people’s name illegally and ride HAPPYBIKE.
2. Users must follow duties and responsibilities in each of the following issues while using HAPPYBIKE.
  - Users must confirm if a running gear and safety device of HAPPYBIKE normally runs or not before riding HAPPYBIKE and stop riding and return the bike immediately in case of failure.
  - Users must be careful of damage and loss of HAPPYBIKE.
  - Users must keep safe speed and wear personal protective equipments.
  - Users must not ride HAPPYBIKE that is intended to be ridden for general living for racing, climbing a mountain, bicycle stunt, and other special purposes.
  - Users must return the bike immediately in case of serious weather situations that might cause negligent accidents.
  - Users must return the bike intact except for general abrasion that might occur while riding a bike.
3. Users must notify an operator of the occurrence of each of the following issues while using the service.
  - If the bike is damaged, lost, and broken down
  - If a user or third party is damaged or meets with an accidents,
4. Users must follow matters notified by an operator in terms of this guideline, relevant laws, user guide, and service. If users violate them, the operator can take necessary measures such as user suspension and abandonment of a right to use a bike.
5. A formal objection and claim for damages is forbidden.
  Users must not demand compensation for any problems caused by users’ deliberate mistake and carelessness while using
HAPPYBIKE provided by an operator except for a range of processing bike security insurance to the operator, related agency, and company such as a formal objection and civil complaint. The operator is not responsible for this.
